Gov. Reynolds issues a disaster proclamation for five western Iowa counties amid flooding

DES MOINES, Iowa (KCRG) – Iowa Governor Kim Reynolds issued a disaster proclamation for Fremont, Harrison, Mills, Monona and Pottawattamie counties on Monday in preparation for impending flooding.

The proclamation allows state resources to be deployed to prepare for and respond to the severe weather.

The proclamation allows the following:

  • Temporarily suspends Iowa Admin legal provisions. Code 11-53.11(3) prohibits the payment of employees in the State of Iowa for hours worked in excess of 40 hours per workweek while on duty at the State’s Emergency Operations Center or otherwise engaged in assigned emergency response missions or other activities.
  • Temporarily suspends the statutory provisions of Iowa Code Chapter 8A, Iowa Code § 313.10, Iowa Admin. Code Chapters 11-117, 11-118 require the Iowa Department of Homeland Security and Emergency Management, the Iowa Department of Transportation, the Iowa Department of Public Safety, the Iowa Department of Health and Human Services, the Iowa Department of Natural Resources, and others government agencies involved in the response to this catastrophic emergency, to purchase goods and services through a competitive selection process.
  • Temporarily suspends the statutory provisions of Iowa Code § 321.449 regarding hours of service for disaster repair crews and drivers providing goods and services while responding to disaster sites during the duration of this disaster, subject to the conditions set forth in Iowa Code § 321.449.
  • Temporarily suspends statutory provisions of the Iowa Code relating to the procurement of goods and services, hours of service for disaster repair crews, and various requirements for the transportation of cargoes related to disaster repairs.
  • Allows vehicles transporting corn, soybeans, hay, straw, silage, stove, fertilizer (dry, liquid and gas), and manure (dry and liquid) to be overweight (not to exceed 90,000 pounds gross weight) without a permit for the duration of this proclamation. This proclamation applies to loads carried on all highways within Iowa (excluding the interstate system) and to loads that do not exceed the maximum gross weight limit of 90,000 pounds and do not exceed the maximum axle load limit set forth in the table of maximum gross weight of non-primary highways. in Iowa Code § 321.463 (6) (a) and (b), by more than 12.5 percent, not exceed the statutory maximum axle load limit of 20,000 pounds, and comply with posted limits on roads and bridges.
