Iowa Governor Kim Reynolds issues a new flood-related disaster proclamation

DES MOINES, Iowa (KTIV) – Gov. Kim Reynolds has issued a proclamation for Buena Vista, Cerro Gordo, Cherokee, Clay, Dickinson, Emmet, Floyd, Fremont, Harrison, Hancock, Humboldt, Kossuth, Lyon, Mills, Monona, O’ Brien, Osceola, Palo Alto, Plymouth, Pocahontas, Pottawattamie, Sioux, Webster, Winnebago, Woodbury, Worth and Wright Counties in response to widespread flooding in Iowa.

The Governor’s proclamation allows for the additional targeted suspension of specific regulatory requirements in affected counties to effectively respond to and recover from the impacts of this event:

  • Temporarily suspends the statutory provisions of the Iowa Code that require a five-day waiting period for the issuance of a replacement copy of an original certificate of title to the owner of a vehicle. Allows a written statement from the owner, included in or attached to the owner’s application for a replacement copy of the original certificate of title, certifying that the original certificate of title has been lost or destroyed.
  • Waiver of fees for the issuance of a replacement copy of an original certificate of title, as applied to an owner or lien holder whose original certificate of title is lost or destroyed.
  • There will be no charge for the issuance of a replacement registration card, license plate or license plate pair, as applied to any lost or illegible registration card, license plate or license plate pair.
  • There will be no charge for the issuance of a duplicate or replacement driver’s license or identity card that does not belong to the operator.
  • Waives fees for each additional car park established by an affected dealer of new or used motor vehicles and waives the requirement that the car park be located in the city or municipality where its principal place of business is located.
  • Waives fees for any additional caravan lots established in addition to the principal place of business by an affected caravan dealer and waives the requirement that the caravan lot be located in the city or municipality where the principal place of business is located.
  • The statutory provisions of the Iowa Code requiring an affected recycler to obtain a separate permit for each county in which an affected recycler does business are temporarily suspended. It also eliminates the requirement that an affected recycler that has established an expansion site to deal with the said emergency situation obtain a separate permit. It also eliminates the requirement that such expansion be located in the same county as the principal place of business or in an adjacent county in Iowa.
  • Waiver of fees collected by the State Registrar of Vital Statistics or a county recorder for a certified copy or brief certification of a certificate or document, a search of the files or records when no copy has been made, or when there is no record in the file has been found.
  • Temporarily suspends statutory provisions of the Iowa Code relating to the procurement of goods and services, hours of service for disaster repair crews, and various requirements for the transportation of cargoes related to disaster repairs.
  • Temporarily suspends the statutory provisions of the Iowa Code relating to the six-month review requirement for family investment program applicants.
  • Temporarily suspends statutory provisions of the Iowa Code that require counties to submit applications for awarded county funding grants.
  • Temporarily suspends statutory provisions of the Iowa Code requiring children’s homes to be located in a single-family home.

The Governor’s proclamation also allows for the additional targeted suspension of specific legal requirements in Clay County:

  • Temporarily suspends the statutory provisions of the Iowa Code prescribing expiration dates for vehicle registration, registration cards, and license plates as applied to a person whose vehicle registration, registration card, or license plate has expired. The suspension of this provision is limited to vehicle registration, license cards, and license plates that have expired within the 60 days prior to this proclamation or during the term of this proclamation or any subsequent extension of this proclamation.
  • Temporarily suspends the statutory provisions of the Iowa Code that require an acquirer of a new motor vehicle to obtain new registration and a new certificate of title within 30 days of purchase.
  • Temporarily suspends the statutory provisions of the Iowa Code that require a vehicle without license plates to be operated on the highways of this state for a period of 45 days after the date of delivery of the vehicle to the purchaser by a dealer.
